RULES AND CONDITIONS
The following Terms and Conditions apply to $1000 POP QUIZ promotion
to be run on NXFM in Newcastle.
These Terms and Conditions apply in conjunction with NXFM’s
General Contest Rules. Where there is any inconsistency, these
terms and conditions will prevail.
These terms and conditions can be collected at the NXFM reception
desk at 252 Pacific Highway, Charlestown and can be downloaded
from the website at http://www.nxfm.com.au
1 METHOD OF ENTRY
Each week day morning from 6am Steve & Kim will invite listeners
to call 13 10 60, to play the $1000 pop quiz. NXFM will then randomly
select one nominated caller each week day morning (Monday –
Friday, except public holidays) inviting them to play the $1000
Pop Quiz. The entrants will be given 60 seconds to answer ten
trivia questions. These questions will be set by NXFM in its absolute
discretion.
Once chosen to play, the participant is unable to play again for
another period of six (6) months. If the participant’s calls
again and is selected within this period of six (6) months, NXFM
will randomly select another participant. A failure by NXFM to
enforce any of these rules in any instance(s) will not give rise
to any claim by any other person or contestant.
If the successful entrant correctly answers all ten questions
within 60 seconds they will win $1000. If they do not correctly
answer all ten questions within 60 seconds they will win a consolation
prize.
The entrant may pass on any question and come back to it if time
permits. They will not have the opportunity to correct any questions
answered incorrectly on the first attempt. The entrant must not
have assistance provided to them by another person. If NXFM becomes
aware that a winner received assistance, the prize will not be
awarded.
An entrant will be judged to have correctly or incorrectly answered
a question according to the absolute discretion of NXFM staff
and no discussions or correspondence will be entertained.
If in the course of a telephone call the telephone line drops
out or breaks up NXFM retains the right to proceed to another
entrant. In such event, NXFM will not be responsible for the awarding
of any prize to the caller whose line dropped out or broke up.
From time to time, NXFM’s announcers may
provide clues as to what may be contained in the $1000 Pop Quiz
questions. This will be done at the sole discretion of NXFM.
2 DURATION
The promotion will run weekday mornings at 7:00am from Monday
17 January 2011 until Friday 9 December 2011 (excluding public
holidays and weekends).
THE PRIZE(S)
Each consolation prize will comprise of a CD or something similar.
Each major prize will comprise of a $1000 from a promotional sponsor
and client of NXFM at the time of winning.
NXFM will notify the winner when the prize money will be available
and will require the winner’s permission to pass on their
details to the segment sponsor.
3 All prizes are non-transferable.
4 In the event that the announcer becomes aware that the same
person has been the successful caller through more than once that
caller be disqualified and another caller taken at the absolute
discretion of NXFM staff. All decisions and actions of NXFM shall
be exercised according to the stations absolute discretion and
no discussion or correspondence will be entertained.
5 USE OF PHOTOS etc.
All contestants acknowledge that it is a condition of entry that
NXFM has the right to publicise their names, characters, likenesses
or voices for any promotion or matter incidental to the competition.
The winner may also be required by NXFM to participate in a photo,
video and/or film session and acknowledges that NXFM has the right
to use such publicity photos, videos and/or films in any medium
and in any reasonable manner it sees fit, unless that person advises
NXFM at the time of entering the competition that he/she wishes
to retain his/her anonymity.
Contestants also acknowledge that their photo may
be used for a promotional display at the prize provider’s
location.
It is a condition of entering this competition that contestants
consent to their entry being read out on air and to their telephone
and other conversations with NXFM being broadcast on air.
6 INDEMNITY
All contestants release from, and indemnify Radio Newcastle 000
225 525 against, all liability, cost, loss or expense arising
out of acceptance of any prize(s) or participation in the competition
including (but not limited to) personal injury and damage to property
and whether direct or consequential, foreseeable, due to some
negligent act or omission or otherwise.
7 NOTIFICATION
All prize winners will be notified on air at the time of the contest.
A follow up phone call will be made to the winner outlining the
delivery process.
8 Winners of minor prizes will be required to pick up their prize
from the NXFM reception at 252 Pacific Highway, Charlestown. All
winners must present identification (incorporating a photograph)
when collecting their prize and sign a copy of these Terms &
Conditions.
9 All winners will be responsible for any and all taxes incurred
in relation to their receipt of their prize.
10 Employees and their immediate families of NXFM and Radio Newcastle
Pty Ltd are ineligible to enter. Employees and their immediate
families of all associated sponsors and participating companies
are also ineligible to enter.
11 If the winner of the major prize is under the age of 18 years,
that prize may at the absolute discretion of NXFM be awarded to
that winner’s parent or guardian.
12 It is a condition of entry that all winners of all prizes must
sign these terms and conditions and the NXFM General Contest Rules
both in a form prescribed by Radio Newcastle Pty Ltd in order
to receive their prize.
14. In all matters, all decisions of NXFM staff will be final
and cannot be contested. No correspondence or discussions will
be entertained.
15. PROMOTER
The promoter is Radio Newcastle Pty Ltd trading as NXFM of 252
Pacific Highway, Charlestown.
